General Terms and Conditions
Introductory Provisions
These General Terms and Conditions (hereinafter “GTC”) govern the rights and obligations of users of the hiarts.app portal (hereinafter “Portal”) and the Portal’s operator.
The operator of hiarts.app is Filip Balada, ID No. 07602456 (hereinafter “Operator”).
By registering on the Portal, users confirm they have read and agree to these GTC.
Definitions
User: Any person who creates an account on the Portal.
Artist: A user who creates a profile as an artist and uploads artworks.
Artwork: An original piece created and uploaded by an artist that may be marked “For Sale”.
Visitor: A person who visits the Portal without registering.
Premium Membership: A paid plan allowing artists to upload unlimited artworks.
Registration and User Account
Registration is free and intended for persons over 18 with full legal capacity.
Users must provide truthful and complete information.
Users are responsible for protecting their login credentials and must not share them.
The Operator may deactivate any account suspected of violating these GTC or applicable laws.
Artist Profile
Artists receive a public profile.
They may upload only artworks that comply with the law and do not infringe third-party rights.
Artists must hold all rights or licenses needed for publication and sale.
The Operator may remove any content that violates laws or is inappropriate.
Artwork Sales
Artworks marked “For Sale” can be purchased through Stripe.
The Operator charges:
Buyer Protection Fee: Ensures full refund within 3 weeks after purchase if needed.
Service Fee: Covers admin costs.
The Operator does not take a commission from the artwork’s price.
Artists are paid in full after 3 weeks unless a delivery or condition issue is reported.
Buyers must report such issues within 3 weeks of delivery.

Delivery Options
Artworks are held by artists, who pack and ship them.
Delivery takes 3–14 business days.
Free personal pickup from the artist is available.
Courier service via Messenger.cz is also supported for home delivery.
Premium Membership
Billed monthly or annually and renews automatically unless canceled.
Details, pricing, and benefits are listed on the Portal.
Artists may cancel anytime, but no refunds are given for the current term.
Data Protection

Liability
The Operator is not liable for damages unless caused by intent or gross negligence.
Users are responsible for uploaded content and must ensure it complies with law.
The Operator is not liable for quality, origin, or legality of artworks.
Intellectual Property
All Portal content is protected by copyright and IP laws.
No content may be used without prior written permission.
Users grant the Operator a non-exclusive license to display, promote, and sell uploaded content.
Termination of Service
The Operator may terminate any service at any time without stating a reason.
Users will be informed and given access to their data.
Dispute Resolution
Disputes will be resolved amicably whenever possible.
If not, they fall under the jurisdiction of Czech courts.
Final Provisions
The Operator may amend these GTC at any time; updates are effective upon publication.
If any clause is deemed invalid, the rest remains effective.
These GTC are valid from August 5, 2024.
